TEST
General
Information The aim of the test is to assess the “aptitude” of the candidate and is limited to the professional knowledge of the candidate. The test aims to assess the ability of the candidate to practice as a solicitor in England and Wales.
To pass the test candidates should be able to:
(a) Identify problems arising from factual circumstances presented in question papers and deal appropriately with them.
(b) Explain the reasons for their answers and support their reasoning by reference to authorities including statutes, cases and practice rules.
(c) Where the test paper contains documents and/or forms, interpret completed documents or forms and discuss their legal and practical applications.
Test(s)
| The QLTT covers four main subject areas (known as Heads). These are are as follows:

- Head I -Property: a three hour written examination
- Head II – Litigation (Civil or Criminal), a three hour written examination
- Head III -Professional Conduct & Accounts, a three hour written examination
- Head IV -Principles of Common Law, an oral examination

Not all lawyers taking the test will be required to sit all four Heads, as it is depends upon the jurisdiction in which they are qualified. An Indian lawyer is required to sit for Head III (Professional Conduct and Accounts). For those lawyers whose basic medium of instruction was not English during your LL.B course, in addition to Head III they may also be required to sit Head IV (Principles of Common Law).
If a candidate wishes to apply for a test exemption, he/she will be required to show that they have passed an examination or other formal assessment within the previous five years that covered the knowledge of the areas covered by a particular head of the test.

N.B Please note that eligibility to sit the Test(s) stated above is subject to the Solicitors Regulation Authority (SRA) regulatory changes Candidates must obtain a Certificate of Eligibility from the
SRA before enrolling for the QLTT Test(s).
Examinations:
Examinations will require a candidate to demonstrate:

An ability to solve legal problems in a practical context.

A clear understanding of substantive legal knowledge.

An ability to apply substantive legal knowledge to practical
problems.

An ability to deliver appropriate solutions to legal problems
English Proficiency
To pass the test, you will need to satisfy the examiners that your knowledge of English is at the standard needed to practice as a solicitor in England and Wales.
Open Book Examination
The QLTT is an open book exam. A suggested reading list is detailed in the Testing and Administration Handbook (sent to candidates upon registration).
Oral Examinations:
Oral Examinations will require a candidate to demonstrate:

Knowledge and understanding of the principles of the common law and the manner in which they apply in practice.

A working knowledge of the legal system.

A working knowledge of the principles of statutes and substantive
law.

Competence in the English Language.
The Written Standards of Each Head
Candidates are required to pass each Head, subjects stated by the Candidate’s Certificate of Eligibility, which that candidate is required to pass. Their performance in a Head may not be compensated by their performance in any other Head.
Head-III- Professional Conduct & Accounts
The test consists of a three hour exam, divided into two parts:
Candidates are required to sit both parts of the exam. Questions on the Solicitors Accounts Rules carry 40% of the available marks. Questions on Professional Conduct, Financial Services and Money Laundering carry 60% of the available marks. Questions on Financial Services carry at least 15% of the available marks. The pass marks for the examination is 50%.
A candidate who sits Head III must obtain at least 50% of the marks attributable to the Professional Conduct/Financial Services/Money Laundering part of the examination, as well as obtain at least 50% of the marks attributable to the Accounts part of the paper. To pass the test candidates are required to gain a pass mark in each part of the exam.
Head-IV- Principles of Common Law
The duration of the test is 30 – 40 minutes. Candidates will be notified in advance of the subject area they will be tested on.
This oral test requires a candidate to demonstrate a knowledge and understanding of the principles of Common Law. Competency in the English language will also be assessed. Please note that there will be no tuition course for Head IV. For further assistance please contact our offices.
